You're pushing a lot of traffic to one side an hoping they're telling you the truth on what they're doing (or not doing). VPN to me is a strange thing for people to put stock in. Of course, if you dont do due dilligence then its only your own fault. And they may not be very clear about where these things are. Just because the VPN provider is in some nation doesn't mean the VPN server you're accessing is. Now if you're doing something stupid like routing all your traffic via the VPN, you might have an issue, but that can be solved by a smarter use of technology. latency isnt really an issue as much these days as multiple streams generally allow you to saturate a link regardless of the latency on it.
Where they have servers isnt the problem, where they have offices is the real question. So VPN providers have pressure to put servers close to their users. The problem with that is the reality that latency is a real issue in network traffic.
